Men in rape case ‘could just kill the bitch’

TWO men allegedly discussed killing a girl at the centre of a sexual assault case.

Within hours of police intercepting that phone call, the two men and a third were arrested and charged with the sexual assault of a 15-year-old girl, Ballina Local Court has heard.

The three men from the Ballina area are aged in their 30s and 40s.

"There was a lawfully recorded conversation between two of the parties where there were threats made to kill the victim," Detective senior constable Andrew Fraser told the court.

Det Fraser told the court in the 11-minute conversation recorded on March 1, Shannon Pracy and Peter Cooper discussed that they "could just kill the bitch".

Peter Cooper and Justin Pracy appeared before Magistrate David Heilpern to answer charges of aggravated sexual assault of a victim under 16, while Pracy's brother Shannon elected not to appear in court.

The court heard there was a strong case against the trio about the alleged incident.

On Australia Day 2012 it was alleged the girl came in contact with Cooper and the Pracy brothers, who proceeded to smoke cannabis with her before she disclosed her age.

It was alleged the girl agreed to perform a sex act with one of the men before the alleged aggravated sexual assaults occurred.

In June the girl approached a solicitor, who contacted Ballina police.

Police conducted a nine-month investigation that included obtaining listening device recordings from the Pracy brothers' house.

The Pracy brothers were arrested just after midnight on March 2 in Ballina and Cooper about 1.30pm.

Cooper and Justin Pracy both applied for bail.

Mr Heilpern refused both men bail and Shannon Pracy did not apply for bail.

The men's matters were adjourned to next month at Lismore Local Court.
