Man who exposed himself to 5-year-old girl had child porn

A MAN exposed his penis to his friend's five-year-old daughter, took off her underwear and took a graphic photo.

Months later, police searched the man's phone and found 131 child exploitation images.

The 39-year-old Mackay man, who can't be named for legal reasons, pleaded guilty to indecent treatment of a child under 12, taking indecent photos of a child and possessing child exploitation material in the District Court in Mackay this morning.

Crown prosecutor Nathan Crane said that on the day of the offence - February 28 last year - the girl had been entrusted to the man's care.

He said initially the man had asked the girl to remove her underwear and, when she refused, he had told her he would "tell people at her school that she'd been naughty".

Mr Crane said that when the girl's father returned home, she had made a complaint immediately and the father had demanded the man hand over his phone. The man had refused and later police obtained a search warrant.

On May 7 last year, the man was found in possession of 131 pornographic images of children, including seven category four images, including one of a 10-year-old girl.

Mr Crane presented a victim impact statement written by the girl's mother.

Defence barrister Phillip Moore said the man had been diagnosed with paranoid schizophrenia when he was 21 years old.

He said the man had sought community mental health support for "unwanted sexual thoughts" prior to and after the offending.

Mr Moore said the man had shown remorse, telling him "it's not right for a kid to grow up with scars".

He said the man had worked in the sugar industry, in the mining industry and most recently in security.

Mr Moore submitted that exceptional circumstances, including the man's mental illness, which included auditory hallucinations, meant the man could be spared actual prison time.

Judge Deborah Richards adjourned the matter for sentencing on Wednesday.
