Man who took 74 lewd photos escapes jail

AN elderly man who took sneaky lewd photos of women's genitalia around Cairns must be on his best behaviour for the next two years.

Nicholas Michael Nicholas, from Western Australia, had been holidaying in Cairns visiting friends when he was busted with 74 images on his phone.

The Cairns Magistrates Court was told that Nicholas had been taking photographs of adult women's genital region while wandering up and down the Cairns Esplanade.

He was found out after one of his victims spotted what he was up to and reported it to police.

The 71-year-old pleaded guilty to 74 counts of making a recording in breach of privacy in court on Monday.

The court was told that the offending had occurred while Nicholas, who had been unemployed for decades due to mental health issues, had been left on his own.

Police were told about a man taking photos and when they approached Nicholas, he admitted to everything and was cooperative.

The court heard he has no criminal history and was remorseful.

Nicholas was placed on a $1000 two-year good behaviour bond and convictions were recorded.

Speaking outside court, Far North police Det Acting Insp Mick Gooiker said this type of behaviour was particularly concerning and should not be tolerated.

"Police take these matters extremely seriously," he said.

"It is something we would encourage people to report if they have concerns about people using cameras.

"Young girls and women should not have to tolerate this type of behaviour in public places."

He said they had been unable to identify many of the subjects of the photos which were taken over a number of days during Nicholas' stay in Cairns.
