David v Coaliath: Grazier takes mining giant to court

CHINESE mining giant Yancoal will face local grazier David McCabe in the Land and Environment Court in the new year.

Yancoal's submission to purchase David McCabe's 517 acre block was met with a counter-submission from his solicitor this month.

Yancoal has since expressed its wish to settle the protracted dispute in an oral hearing outside of court, but Mr McCabe said he wanted to settle the matter publicly.

The grazier wished to keep his property.

"I want to keep the deeds," he said.

"We have got to find out how much they will be mining, and whether we will even be able to come back."

MacMahon contractors vacated the Cameby Downs coal mine on December 1, making way for Yancoal personnel to take over.
