‘Cruel’ judge removed from court after attack on lawyers

A Townsville judge who has been criticised for his treatment of parties appearing before him has been removed from the city to undergo training on how to behave at court.

Judge Guy Andrew, who was appointed Townsville's full-time Federal Circuit Court Judge in March last year, has been transferred to Brisbane to receive counselling and mentoring, where his sittings will also be monitored.

The move comes days after the judge was criticised in an appeal court judgment for being "cruel, insulting, humiliating and rude" towards Queens's Counsel Graeme Page and another solicitor representing a father in a family law case.

The Full Court of the Family Court found Judge Guy Andrew was also "hectoring, insulting, belittling, sarcastic and rude" in his treatment of Mr Dwyer.

Three Full Court judges ordered a rehearing of the parenting and property settlement case before a different Federal Circuit judge.

"The tone, nature and ferocity of His Honour's comments could never be seen as justified," the judges said.

It resulted in the father not getting a fair trial and raised apprehended bias, that no matter what the father's case was as presented, it would be rejected, the judges said.

A Federal Circuit Court of Australia spokeswoman said a decision on Judge Andrew's future in Townsville would be decided before the Christmas break.

In the event he did not return to Townsville, another judge will be assigned to the registry.

"Of utmost importance and priority to the Court is that the families of Townsville and the region of North Queensland that need the services of the Court to have their family law dispute dealt with in a respectful manner," she said.

Townsville region will still be serviced by the Federal Court of Australia with more judge time and extra resources where necessary.

All matters listed before Christmas will remain listed and be heard by two "extremely experienced judges" in Townsville.
