Dyraaba fatal driver to spend Christmas behind bars
THE disqualified driver of a car involved in a crash that killed a father and his two children at Dyraaba near Casino in June will spend Christmas behind bars.
Shaun Zagar, 28 and his children Kaleb, 6, and Zara, 5, were killed while waiting for a school bus near Martins Rd and McDonalds Bridge Rd when the Magna driven by Malcolm Harris crashed into their Mazda on June 4.
The court previously heard Harris was under the influence of a cocktail of drugs including methadone, diazepam and marijuana at the time of the crash.
Harris, 36, appeared by video from jail on 13 charges including dangerous driving occasioning death, driving while disqualified and driving with an illicit drug in his blood.
His solicitor Ms Maranga applied to have his matters adjourned because she had taken over the case from a colleague who was on leave and hadn't had time to interview Harris.
She was also waiting on pharmacological advice.
Magistrate David Heilpern questioned why Harris had not been interviewed by the legal team.
He adjourned the matters to next month when Harris will be committed for sentence or trial.
