Assault upgraded to murder
A 36-year-old Tweed Heads man has had assault charges upgraded to murder in the Lismore Local Court today following the death of the victim yesterday.
David Mitchell, 42, died in the Gold Coast Hospital, at about 5am yesterday, from head injuries believed to have been sustained during the attack.
His alleged attacked, Gareth Lewis, did not appear in court nor did he apply for bail which was formally refused.
The court heard that investigating officers were still compiling their brief of evidence against Lewis and were awaiting results from the post mortem which was carried out today.
Mr Mitchell, who was assaulted at his home in Dry Dock Rd, Tweed Heads, on July 1, was driven to Tweed Heads Hospital with serious head injuries by another man about 11am that day.
The unconscious man was treated by staff and later transferred to the Gold Coast Hospital in critical condition.
During the incident the victim was allegedly punched to the head a number of times and fell to the ground where he was stomped on before a number of witnesses intervened.
The case was listed for mention again in Lismore Local Court in October.
